This assignment is the second of 2 'Critical Theory Exercises' across the semester. The aim of this task is to draw on theoretical concepts discussed in the course in weeks 7, 8, and/or 9, to critically analyse a chosen topic/case study. You'll choose to write on one of the following topics.

Topic 1 - Bail in Australia

Multiple jurisdictions across Australia, including the Northern TerritoryLinks to an external site. and QueenslandLinks to an external site. (see also here Links to an external site.and hereLinks to an external site.) have recently introduced tougher bail conditions including presumptions against bail for particular offences. A similar toughening of bail occurred in VictoriaLinks to an external site. (see also hereLinks to an external site.) after James Gargasoulous killed 6 people with his vehicle on Bourke Street in 2017Links to an external site..

There are concerns that these approaches have led to increased rates of people being held on remand without trial.  This has disproportionately impacted women who have been targeted by criminal justice interventionLinks to an external site.. This has also meant that that people without stable accommodation or a fixed addressLinks to an external site. can be more likely to be denied bail and thus spend longer terms on remand. Links to an external site.

How can criminological concepts and theory help us to understand the moves toward toughening access to bail?  Critically discuss with reference to 1 - 2 course theories/concepts from weeks 7, 8 and/or 9

Topic 2 - Policing in the Pandemic

The Victorian ombudsman recently found the Victorian Government’s lockdown of public housing towers in North Melbourne and Flemington during the Covid-19 pandemic was “not compatible with the residents’ human rights, including their right to humane treatment when deprived of liberty” (Glass, 2020). A key aspect of this Governmental response was the deployment of police to enforce public health orders Download deployment of police to enforce public health orders. More broadly, increased policing has been a central dimension of the pandemic response with the issuance of fines key to seeking compliance. However there have been suggestions that this response has exacerbated already existing social inequalities.

What can the Covid-19 pandemic response tell us about power and inequality? Critically discuss with reference to 1 - 2 course theories/concepts from weeks 7, 8 and/or 9

General Instructions

For this short analysis, you'll be relating key theories, concepts and themes from across week 7, 8 and 9 of the course to this case study. Week 7 theories pertain to gender, sex and justice, week 8 focuses on race/racialisation and criminalisation, week 9 focuses on settler colonialism. The word count is 750 words so it's important to plan the work and locate which concepts you think can help effectively understand the issue you've chosen.

This assignment is to help build theory comprehension skills, critical thinking, and ability to succinctly detail and apply criminological concepts to a real-world case study. As noted, the response should be 750 words (with 10% leeway), written in academic style, and use APA referencing.  The assignment should be written using a clear and readable font (e.g Calibri, Times New Roman, Arial, Courier or Verdana - and I personally love Garamond as well), sized 11-12 point font, and the text is justified (straight on both sides) and 1.5x spaced.

It is fine to use course readings for this task, but you are encouraged to locate a couple of other good quality sources as well. A reminder that LECTURES SHOULD NOT BE CITED IN YOUR RESPONSE.
